§1About these Terms
These Terms of Use govern access to and use of the JapanoMa website, platform, tools, forms, content, guides, communication features and related services (together, the Platform).
The Platform is branded as JapanoMa and is owned and operated by GO & C Partners Pty Ltd (ABN 77 692 821 926), an Australian company registered with ASIC (GO & C Partners, we, us, our).
In these Terms, references to JapanoMa mean the website, platform and trading brand operated by GO & C Partners Pty Ltd. Your legal relationship is with GO & C Partners Pty Ltd, as the operator of the Platform.
By accessing or using the Platform, you agree to these Terms. If you do not agree, you must stop using the Platform.
§2What JapanoMa does
JapanoMa is an Australia-facing property discovery, decision-support and cross-border ownership support platform operated by GO & C Partners Pty Ltd for Australian consumers interested in residential property in Japan.
JapanoMa may provide:
- educational content, articles, guides and checklists
- search support and matching tools
- curated property introductions and property information summaries
- communication and enquiry support tools
- translation-supported communications
- post-introduction and post-purchase support coordination
- introductions to licensed Japanese real estate companies and related service providers
- other related features announced from time to time
§3What JapanoMa does not do
Neither JapanoMa nor GO & C Partners Pty Ltd is a Japanese licensed real estate broker or agent unless expressly stated otherwise.
Neither JapanoMa nor GO & C Partners Pty Ltd itself:
- sells real property in Japan
- acts as a Japanese real estate intermediary or broker
- negotiates sale contracts as agent for buyer or seller
- provides the legally required explanation of important matters under Japanese real estate law
- replaces licensed Japanese real estate companies, judicial scriveners, lawyers, tax advisers, architects, surveyors or other professionals
Any regulated sales activity relating to properties in Japan is handled by appropriately certified, licensed and qualified Japanese real estate companies or professionals.
§4Japan property context
All properties listed, introduced, discussed or referred to through the Platform are located in Japan and are subject to Japanese laws, regulations, procedures, taxes, market conditions and local practices.
You acknowledge that buying and owning property in Japan may involve cross-border legal, tax, banking, language, translation, verification, utilities, management and lifestyle support issues.
§5Eligibility
To use the Platform, you must:
- be at least 18 years old
- have legal capacity to enter into a binding agreement
- use the Platform only in compliance with applicable law
§6Account registration
If you create an account or submit an enquiry, you must provide information that is accurate, current and complete, and keep it updated where relevant.
You are responsible for maintaining the confidentiality of your password and account credentials and for all activity under your account.
§7Fees and paid features
Some services or features may be offered for a fee by GO & C Partners Pty Ltd through the JapanoMa Platform. If fees apply, JapanoMa will disclose the relevant pricing, billing terms and cancellation arrangements before you commit.
Unless required otherwise by law, fees for paid services are non-refundable.
Nothing in these Terms excludes any rights or remedies that cannot be excluded under the Australian Consumer Law.
§8No personal advice
Information on the Platform is general in nature only. It is not legal, financial, tax, migration, building or personal real estate advice.
You should obtain your own independent professional advice before making decisions about any Japanese property.
§9Property information and introductions
Property information on the Platform may come from Japanese real estate companies, sellers, public sources, third-party providers, translations, summaries or internal curation by JapanoMa / GO & C Partners Pty Ltd.
GO & C Partners Pty Ltd does not guarantee that any property information is accurate, complete, current, available, investment-suitable or appropriate for your circumstances.
Any shortlist, introduction, match, recommendation or featured property is for information and convenience only. It is not a promise of suitability, financeability, legal usability, renovation feasibility, minpaku eligibility, future resale value or investment performance.
§10Third-party real estate companies and service providers
JapanoMa may introduce you to licensed Japanese real estate companies and other third-party providers relevant to the search, purchase, ownership and lifestyle journey.
Those parties are independent from GO & C Partners Pty Ltd unless expressly stated otherwise. They may have their own terms, fees, privacy practices and professional obligations.
GO & C Partners Pty Ltd is not responsible for independent third-party services, although JapanoMa may assist with coordination and communication.
§11Acceptable use
You must not:
- use the Platform unlawfully
- harass, abuse or defame others
- upload unlawful, harmful or offensive material
- misuse communication features
- impersonate another person
- scrape, crawl, extract or systematically harvest Platform data
- reverse engineer or interfere with Platform tools
- upload malware, viruses or destructive code
- reproduce or exploit Platform content except as allowed by law or with written permission
§12AI, automation and translation tools
Some Platform tools may use AI, automation, translation or rules-based processing.
These tools are assistive only. GO & C Partners Pty Ltd does not guarantee that outputs are accurate, complete, reliable, legally sufficient or suitable for your circumstances. You must independently verify important matters.
§13User content and submissions
If you submit feedback, comments, enquiries, forms, messages, documents or other content to JapanoMa, you grant GO & C Partners Pty Ltd a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, adapt, translate and communicate that material for the purpose of operating, improving and supporting the Platform and related services.
You warrant that:
- you have the right to provide the material
- the material does not infringe another person’s rights
- the material is not unlawful, misleading, defamatory or offensive
JapanoMa may remove content where reasonably necessary.
§14Intellectual property
The Platform and its content, including text, graphics, branding, layouts, software, tools and compilations, are owned by GO & C Partners Pty Ltd or its licensors and protected by law.
You may use the Platform for personal, lawful, non-commercial use only unless GO & C Partners Pty Ltd agrees otherwise in writing.
§15Third-party links and content
The Platform may contain links to third-party websites, services and content. These do not necessarily represent JapanoMa’s or GO & C Partners Pty Ltd’s views or endorsement.
If you access third-party content or services, you do so at your own risk.
§16Suspension and termination
GO & C Partners Pty Ltd may suspend, restrict or terminate your access to the Platform where reasonably necessary, including for breach, misuse, security, legal risk or operational reasons.
§17Disclaimer
To the maximum extent permitted by law, the Platform is provided on an “as is” and “as available” basis.
GO & C Partners Pty Ltd does not guarantee uninterrupted availability, error-free operation, translation accuracy, successful property acquisition, investment outcome, legal suitability, finance approval or any particular result from use of the Platform.
Nothing in these Terms excludes rights that cannot lawfully be excluded under the Australian Consumer Law.
§18Limitation of liability
To the extent permitted by law, GO & C Partners Pty Ltd excludes liability for indirect, incidental, special, punitive or consequential loss, including loss of profit, revenue, goodwill, opportunity, data or anticipated savings, arising from or in connection with the Platform.
Where liability cannot be excluded, it is limited to the maximum extent permitted by law.
§19Indemnity
You agree to indemnify GO & C Partners Pty Ltd and its officers, employees and agents against claims, losses and expenses arising from:
- your misuse of the Platform
- your breach of these Terms
- your infringement of another person’s rights
- material you submit through the Platform
This indemnity is reduced to the extent the loss was caused or contributed to by GO & C Partners Pty Ltd.
§20Changes to these Terms
GO & C Partners Pty Ltd may update these Terms from time to time by publishing an updated version on the JapanoMa Platform. Continued use after publication constitutes acceptance of the revised Terms.
§21Governing law
These Terms are governed by the laws of New South Wales, Australia.
Nothing in these Terms excludes, restricts or modifies rights or remedies available under the Australian Consumer Law.
